Order terms & condition
Order Terms & Conditions
These Terms & Conditions (“Terms”) apply to all orders placed with The Nua Studio, whether for ready-made products or custom-made furniture. By placing an order, the client acknowledges and agrees to the following:
1. General Orders (All Products)
-
All prices, specifications, and descriptions are accurate to the best of our ability but may be subject to change due to material availability or updates.
-
Natural variations in wood, laminates, and finishes (grain, tone, texture, color) are normal and not considered defects.
-
Warranty for all products is provided under The Nua Studio Warranty Policy, which can be viewed here: Warranty Policy.
-
The Nua Studio’s liability is limited to the repair or replacement of the product only, and does not cover incidental or consequential damages (such as business losses, lost income, or missed opportunities).
2. Custom & Made-to-Order Items
-
Custom-made and made-to-order furniture are non-refundable and non-returnable once production has started. Deposits for custom projects are also non-refundable.
-
Clients are responsible for reviewing and approving all designs and specifications before production begins.
-
If the design is provided by the client, The Nua Studio is not liable at any time — whether during production, after completion, or later — for structural, functional, or usability issues arising from that design.
-
While we may recommend improvements for durability or safety, the client shoulders any additional costs for revisions, rework, or adjustments if issues are discovered at any stage.
-
Following a client’s exact design request does not transfer responsibility to The Nua Studio for flaws, limitations, or failures inherent in that design. If such flaws are discovered, The Nua Studio is open to working with the client on solutions, but any additional materials, labor, or modifications required will be at the client’s expense.
-
-
If the client is not experienced in furniture design, The Nua Studio may provide guidance, but the client acknowledges that actual performance may differ once built.
-
Production timelines for custom work are estimates and may extend depending on material availability, revisions, or site conditions.
3. Stains, Finishes, Laminates & Colors
-
Colors may look different on monitors or phones compared to actual materials due to screen settings, lighting, and natural absorption.
-
Clients may request a physical swatch to confirm stain, finish, or laminate before approval. Swatches may incur an additional fee.
-
Clients understand that:
-
Wood has natural grain variation, and no two pieces are identical. Grain differences are not covered under warranty or grounds for rejection.
-
Laminates & veneers, while more consistent, have fixed patterns that may repeat differently across a larger surface. A small swatch may not represent the full layout, and this is not grounds for rejection.
-
Lighting conditions affect appearance. The same stain or finish may look lighter/darker under different lighting. Clients are encouraged to test swatches in the actual location and lighting where the furniture will be placed.
-
-
Once a stain, laminate, or finish is approved, The Nua Studio is not liable if the client later changes their preference.
-
For custom color matching, once the finish is approved and applied, it cannot be rejected solely on preference. Approval relates to the color, not the exact wood grain or laminate pattern.
4. Delivery, Installation & Site Conditions
-
Clients must ensure the site is ready, accessible, and suitable for delivery and installation.
-
The client is responsible for permits, gate passes, parking space, and delivery fees.
-
If site conditions differ from what was communicated (e.g., wall type, uneven flooring, missing fixtures), the client shoulders the cost of any extra materials, labor, or rework required.
-
Unsafe installations (e.g., walls not suited for fasteners) may be declined to protect the product, property, and workers.
-
Clients are responsible for moving or covering belongings during installation. The Nua Studio is not liable for damage to items not properly protected.
-
Basic cleaning of installation debris will be provided, but a deep clean or detailed post-installation cleaning is the responsibility of the client.
-
The Nua Studio is not responsible for damages caused by other trades or contractors working on-site after installation (e.g., painters, electricians, movers).
5. Delays, Storage & Abandoned Orders
-
The Nua Studio is not responsible for delays caused by client late responses, design changes, missing permits, or force majeure.
-
The Nua Studio is not liable for indirect losses (such as lost profit, rental delays, or income disruptions) resulting from delivery schedules or disputes.
-
For finished products with delayed delivery due to client unavailability, a storage fee of PHP 200/day will be charged after one week.
-
Orders that remain unclaimed, unpaid, or orphaned for more than three (3) months may be disposed of or resold. In such cases, The Nua Studio will not be liable to refund or replace the order.
6. Accessories & Client-Supplied Items
-
The Nua Studio is not responsible for defects, damage, or incompatibility in appliances, hardware, or accessories provided by the client.
-
If client-supplied items cause delays, rework, or require troubleshooting, the client shoulders all related costs.
7. Force Majeure
-
The Nua Studio will not be liable for delays, damages, or inability to complete work caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, fire, flood, pandemic, government restrictions, supply chain disruptions, strikes, transport delays, or acts of God.
-
In such cases, timelines may be extended or orders adjusted without liability.
8. Termination
-
The Nua Studio reserves the right to terminate an order if the client:
-
Fails to settle payments on schedule.
-
Causes significant delays by withholding approvals or access.
-
Repeatedly changes the project scope without agreement.
-
-
Payments made prior to termination are forfeited, and The Nua Studio may pursue claims for damages or unpaid balances.
9. Acceptance of Terms
By placing an order, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
